FDA Responds To Vapor Lawsuits

Earlier this year the FDA released the final deeming regs which is already starting to cripple the vaping industry. Even though most of the new regulations won't take full effect for two years, vape shop owners and manufacturers everywhere are closing their doors to avoid jumping through all the hoops and paying the outrageous fees to stay in the market. 

It didn't take long for a few lawsuits to be filed against the FDA. At one point there were over nine groups with lawsuits filed. Several of the lawsuits were recently ordered to be consolidated by a federal judge. Nicopure labs and The Right to be Smoke-Free Coalition are now fighting together under one umbrella and this is the FDA's 101 page response to the case.

If you don't have the time to read through this short novel here's how it reads:

  • They claim that e-liquid has dangerous compounds in it
  • Mods are exploding in people's faces
  • Nicotine is the most addicted substance known to man
  • The FDA has a lot of money to throw at lawsuits
  • The FDA can be extremely smug when it comes to dealing with the vaping industry

To those of us who have read (and lived) through all the vaping success stories, this response comes off as more of a fear mongering tactic and misinformation campaign for the general public to consume. There isn't really a whole lot of fact based information to justify such a harsh plan to wipe out an entire industry.

If this case does see the light of day in court, it's going to be an uphill battle for us just clearing up all the unjust claims that the FDA has made to the public. What are your thoughts on the FDA's response? Shoot us a comment below and let your voice be heard!

A pack a day for over 30 years. After a friend told me about his ego pen and let me and my wife take a few good hits I went right to my nearest vape shop where we bought a few 650 mah battery’s and a few disposable tanks. I was at zero nicotine within a week and completely off cigs after so many failed attempts. 2 years later and sure it’s turned into such an enjoyable hobby. Yep it’s so nice being able to smell, taste and not gasp for breath going up the stairs. VAPING SAVES LIVES!

I was a 40 year smoker. I got diagnosed with COPD and high blood pressure. I tired all the usual things to quit, even Chantix which made me scared and paranoid. Nothing worked. Then I found vaping. Started with the ecig from the gas station, that helped a bit. Once a shop helped me get a good tank and mod I never smoked another nasty cigarette again. I have my nic down to 3ml. That will be a year ago October 3rd. I breathe better, sleep better, I can do more things and exercise. Lost some weight and my blood pressure is down. Vaping saved my life. I got my husband and a few friends to quit smoking with vaping. Now the FDA wants to take it away. I guess they want us all to smoke and be sick. If I don’t have vaping I am very afraid I will go back to smoking.

It has been over 3 years since i quit smokeing with a vape. I have had family pass away due to smoking. I now have children of my own and i want them to grow up with a father not a memory of one. The FDA are only out for the money they get from big tobacco. My health has improved greatly. Many of my friends have even noticed a change. Again i agree with Tim Swan. Hold the FDA in contempt for false information. You cant say one minute that there isnt enough information to say its healthy then jump straight to its dangerous for us. What kind of crap is that.

I think it’s crazy how Vaping has been attacked already over Diacetyl , with headlines like “Vaping Could Give You ‘Popcorn Lung‘” and “E-cigarettes linked to incurable lung disease.”
They sort of missed out the fact “daily exposure to diacetyl from smoking is 750 times higher, on average than exposure to diacetyl from vaping.” .. yeah amazing how biased the media can be .
My personal experience …
My mother had a heart valve replacement after being a lifelong smoker . they said smoking would probably end up killing her , she swapped to vape overnight and is much healthier for it .
After seeing my mother’s success i was tempted but trying to smoke cheap Cartomisers made me choke . so that put me off for a while .
Recently i decided to try again but buy a proper mod box with a mouth to lung tank and adjustable wattage . it was easy , i’m only on week 3 but ive dropped from smoking 30+ hand rolled cigs a day to 3 !
I plan to quit completely as soon as i feel ready .
I live in england but what happens in the USA usually affects the decisions made around the world . The FDA need to start being honest .
We live in a corporate world where financial decisions and bullshit come before people’s health , this is now becoming a question of how bad is the FDA is for peoples health .

I picked up an e-cigarette last September and haven’t picked up a regular cigarette since. I had been smoking for 40 years and never had much success at stopping for extended periods of time. It’s been almost a year now and I started out with 24 mg nicotene now I am down to 3mg. My doctor was very pleased when I told her I had stopped smoking and was vaping .I can now breath normally when I go up and down the stairs. All atribitted to vaping

Just reading a few of these comments, and thinking about my own experience and the stories I have heard on the smoke deck through the years, I want to present this situation to all those who have no idea about any of this, and to those who just haven’t thought about it this way…

- A large government industry (the Food and Drug Administration) has declared themselves as the sole authority to make decisions on regulations over those three categories.
- Said large government industry has said for years that smoking is terrible for our health.
- To discourage people from smoking, said government agency has charged tobacco manufacturers high fees, causing the prices for smoking to skyrocket, and encouraged or supported severe legislation changes that have made the areas where it is legal for one to smoke to dwindle to nearly absent.
- Because smoking is an addiction, and therefore cannot be quit without unusually high willpower or outside help, said government agency approved several alternatives to smoking to help smokers quit by gradually stepping down their nicotine levels over a period of months or years.
- Judging by long-term smokers’ comments, those methods are difficult to use and might work, at best. The most common complaints, though, are that those alternative methods either do not work at all, or work only temporarily, never truly curbing the constant desire to return to smoking (i.e., the addiction is not broken, only mediated).
- Also judging by long-term smokers’ comments, vaping has helped thousands or even thousands of thousands quit smoking within a few days or weeks. Some have even quit cold turkey. Almost all who claim to have quit through vaping now claim that all desires for returning to cigarettes have vanished, i.e., the addiction is broken, and they are free from smoking.
- Vaping has gained a recent massive surge in popularity, and the business has boomed.
- The aforementioned large government agency is now claiming that vaping is terrible for our health, and wants to charge the manufacturers of vaping high fees…

Can you say ulterior motives? I thought you could.

I’ve been smoke free for about 2 an a half years now since I started vaping I feel great I’ve started at 24 ml of nicotine and now I’m at 3 ml of nicotine. Plus last time I went to the doctors for a physical the doctor asked me if I was still smoking and I told him that no I started vaping the doctor looked at me and said I’d rather have u doing that then smoking. I’ve gotten other people to stop smoking too and now their vaping. Stay strong people vape on

Haven’t picked up a stinky since the end of January this year, never felt better. Big tobacco is just pissed because people are actually quitting their drug and doing a much safer alternative.

I assure you that the tobacco companies are paying to the FDA to say that stuff. they feel threatened by that people have found a better alternative and decided to have a better quality of life and never touch a cigarette again.
